Important: By accessing this website or purchasing any product or service from DynamicStep, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or purchase any service.

1. Introduction

DynamicStep is a sole trader business operated by Scott William Rayment (ABN: 28124155190), trading as DynamicStep, located in Melbourne, Victoria, Australia ("we", "us", "our").

These Terms and Conditions ("Terms") govern your access to and use of the DynamicStep website located at www.dynamicstep.com.au ("Website"), and the purchase and use of any products or services offered through it, including the online course and 1:1 coaching services described in these Terms.

By accessing this Website, enrolling in a course, or purchasing a coaching service, you agree to these Terms in full. These Terms form a binding agreement between you ("you", "your", "User", "Client") and DynamicStep.

We reserve the right to update or amend these Terms at any time. The most current version will be published on this Website. Continued use of the Website or services after any update constitutes your acceptance of the revised Terms.

2. Eligibility and User Requirements

2.1 Minimum Age

You must be at least 18 years of age to purchase or access any DynamicStep product or service. By completing a purchase, you confirm that you meet this requirement. If you are under 18, you must have the consent and supervision of a parent or legal guardian, and that adult accepts these Terms on your behalf.

2.2 Accuracy of Information

You agree to provide accurate, current, and complete information when registering, making a purchase, or communicating with DynamicStep. You are responsible for maintaining the accuracy of any information you provide, including contact details and payment information.

2.3 Medical Clearance

Participation in any exercise-based educational content, program activities, or coaching guidance is at your own risk. Before commencing any exercise program or following guidance contained within DynamicStep products, you should:

  • Consult with a qualified medical practitioner, physiotherapist, or other appropriate registered health professional to confirm your suitability for the activities described;

  • Disclose any pre-existing injury, condition, illness, or recent surgery that may affect your ability to safely participate; and

  • Seek specific medical clearance if you have any doubt about your health status.

DynamicStep does not assess your individual medical fitness to participate and is not responsible for any injury, harm, or adverse health outcome arising from your failure to obtain appropriate medical clearance.

3. Nature of Services

DynamicStep offers the following services:

3.1 Online Course (Self-Paced)

The DynamicStep online course is a self-paced educational program designed to provide general education about chronic ankle instability, including information on rehabilitation principles, exercise techniques, and self-management strategies. The course is delivered digitally via the Payhip platform.

3.2 One-to-One Coaching Services

DynamicStep 1:1 coaching services provide structured coaching support related to chronic ankle instability. Coaching sessions are delivered remotely via video conferencing or other agreed digital platforms.

3.3 Important Distinctions

You acknowledge and agree that DynamicStep services are:

  • Educational and coaching in nature, not clinical treatment;

  • Not a substitute for individualised medical assessment, clinical diagnosis, or healthcare treatment by a qualified, registered health professional;

  • Not clinical consultations and do not create a practitioner-patient relationship solely by virtue of purchase or access, unless otherwise explicitly confirmed in writing by DynamicStep;

  • Not suitable for acute, urgent, or emergency health needs (see Section 4.5 below);

  • Delivered remotely, which has inherent limitations compared to in-person clinical assessment, including the inability to conduct hands-on physical examination.

Nothing in these Terms, on this Website, or within any DynamicStep program constitutes individual medical advice, diagnosis, or a clinical management plan.

4. Medical and Health Disclaimer

4.1 General Health Disclaimer

All content, materials, coaching guidance, and program activities provided by DynamicStep are for general educational and informational purposes only. Results vary between individuals. This content does not constitute individual medical advice and should not be relied upon as such.

4.2 Exercise Participation Risks

Physical exercise and rehabilitation activities carry inherent risks, including but not limited to muscle soreness, joint pain, falls, sprains, strains, fractures, and cardiovascular events. By participating in any exercise activity described or demonstrated in DynamicStep materials, you:

  • Acknowledge and voluntarily accept these risks;

  • Confirm that you have disclosed any relevant health conditions, injuries, or limitations;

  • Take full responsibility for exercising within your own physical limits and abilities; and

  • Agree to stop any activity and seek medical advice if you experience pain, dizziness, breathlessness, or any other concerning symptom.

4.3 No Guarantee of Outcomes

DynamicStep makes no representation or guarantee regarding any specific outcome, result, recovery timeline, or improvement in symptoms or function. Individual outcomes depend on many factors outside DynamicStep's control, including your commitment, physical condition, compliance, and individual response to rehabilitation.

4.4 Pre-Existing Conditions

If you have a pre-existing medical condition, injury, or health concern, you should obtain written clearance from a registered medical practitioner or other appropriate health professional before engaging with any DynamicStep program or following any exercise guidance.

4.5 Emergencies

DynamicStep services are not suitable for emergencies. If you experience a medical emergency, including acute chest pain, difficulty breathing, loss of consciousness, severe trauma, or any other urgent health concern, call 000 immediatelyor attend your nearest emergency department. Do not contact DynamicStep in an emergency situation.

4.6 Limitations of Educational Content

The information and guidance provided within DynamicStep materials is based on general evidence and professional knowledge. It cannot account for your individual anatomy, health history, comorbidities, or clinical presentation. You are responsible for using this information in a manner appropriate to your personal circumstances.

5. AHPRA and Professional Compliance

5.1 Professional Registration

The individual operating DynamicStep holds current registration as a podiatrist with the Podiatry Board of Australia, regulated by the Australian Health Practitioner Regulation Agency (AHPRA). This registration is maintained in accordance with the requirements of the National Law and the Podiatry Board of Australia's standards, codes, and guidelines.

5.2 Scope of This Website

The content on this Website, including the online course and coaching services, is provided as general health education and coaching support, not as clinical podiatric treatment. Website content does not constitute individualised clinical advice and should not be construed as a clinical consultation.

5.3 No Misleading Claims

DynamicStep does not make claims that are false, misleading, or likely to deceive. No guarantee of beneficial treatment is made. Content is intended to educate and support, not to replace assessment by a qualified, registered health professional.

5.4 Limitations of Remote Delivery

Coaching delivered via video conference or other online platforms has inherent limitations compared to an in-person clinical assessment. Remote coaching cannot replicate physical examination, direct observation of movement patterns under controlled conditions, or other components of clinical assessment available in person. If you require a clinical assessment, you should engage with a registered health practitioner in person.

5.5 Referral Obligation

Where a concern arises during a coaching session that, in DynamicStep's professional judgment, warrants referral to another health practitioner, DynamicStep will advise you accordingly. You are responsible for acting on any such recommendation.

6. Payments and Billing

6.1 Course Payments

The DynamicStep online course is available for a one-time payment as displayed at checkout on the Payhip platform. Payment must be made in full at the time of purchase. Access to course materials is granted upon confirmed payment.

6.2 Coaching Services

Coaching services may be purchased as:

  • A one-time payment for a single session or package; or

  • An instalment plan as specified at the time of purchase.

The total amount, instalment schedule, and payment dates will be clearly displayed before you confirm purchase.

6.3 Payment Authorisation

By completing a purchase, you authorise DynamicStep and its payment processor(s) to charge the nominated payment method for the full amount (for one-time payments) or for each instalment (for instalment plans) on the dates specified.

6.4 Failed Payments

If any payment fails, DynamicStep may suspend your access to services or course materials until the outstanding payment is resolved. DynamicStep will make reasonable attempts to notify you of a failed payment. If an outstanding amount is not resolved within 7 days of notification, DynamicStep reserves the right to terminate your access without further notice.

6.5 Currency

All prices are displayed and charged in Australian Dollars (AUD) unless otherwise stated. If you are purchasing from outside Australia, your bank or payment provider may apply currency conversion fees for which DynamicStep accepts no responsibility.

6.6 GST

Prices displayed on this Website include Goods and Services Tax (GST) where applicable under Australian law. International purchasers should be aware that local taxes, import duties, or equivalent levies may apply in their jurisdiction; DynamicStep accepts no responsibility for any such charges.

6.7 Access Conditions

Full access to purchased materials and services is conditional upon receipt of cleared payment. Instalment plan clients will retain access while payments are current. Access may be suspended or terminated for non-payment as described in clause 6.4.

7. Refund Policy

7.1 Online Course

Because the DynamicStep online course is a digital product delivered immediately upon purchase, we are generally unable to offer refunds after access has been granted. By completing your purchase, you acknowledge this and consent to immediate delivery of the digital product.

Exceptions may be considered at DynamicStep's absolute discretion where:

  • There is a material defect in the course content or a significant technical failure attributable to DynamicStep that cannot be rectified within a reasonable time; or

  • A refund is required under a non-excludable right under the Australian Consumer Law (see Section 13).

Change-of-mind refunds are not available for digital course purchases once access has been granted.

7.2 Coaching Services

For coaching packages purchased as a single upfront payment:

  • Cancellation more than 48 hours before the first scheduled session: a refund may be provided, less any reasonable administrative costs.

  • Cancellation within 48 hours of the first scheduled session, or after any session has commenced: no refund is available.

7.3 Instalment Plans

For coaching packages purchased on an instalment plan:

  • Instalments already paid are non-refundable unless required by the Australian Consumer Law.

  • If you elect to discontinue coaching partway through an instalment plan, all remaining instalments remain due and payable unless DynamicStep agrees otherwise in writing.

  • DynamicStep will not pursue remaining instalments where it has been unable to deliver the agreed services through its own fault.

7.4 Missed Sessions

Missed sessions are not refundable. See Section 8 for rescheduling provisions.

7.5 Partial Completion

Refunds are not available on the basis of partial course completion or partial use of a coaching package.

7.6 Exceptional Circumstances

DynamicStep may, in its sole discretion, consider a partial or full refund in genuinely exceptional circumstances, such as a serious medical event that prevents any future participation and is supported by documentation. Such requests should be submitted in writing to [INSERT BUSINESS EMAIL].

7.7 Australian Consumer Law

Nothing in this refund policy limits, excludes, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law. Please refer to Section 13.

8. Coaching Session Policies

8.1 Scheduling

Coaching sessions must be scheduled by the Client through the booking process specified by DynamicStep at the time of purchase. Session availability is limited and subject to DynamicStep's schedule.

8.2 Rescheduling

You may request to reschedule a session by providing at least 48 hours' notice before the scheduled session time. Rescheduling requests made within 48 hours of a session may not be accommodated and the session may be forfeited.

DynamicStep will make reasonable efforts to offer an alternative time within the program period. DynamicStep cannot guarantee availability on any specific date or at any specific time.

8.3 Cancellations by Client
  • Cancellation with 48 hours or more notice: session may be rescheduled without penalty.

  • Cancellation with less than 48 hours' notice: the session is forfeited and no refund or credit will be provided.

  • Three or more cancellations during a coaching program may, at DynamicStep's discretion, result in termination of the coaching agreement. In such circumstances, any remaining sessions will be forfeited without refund.

8.4 Late Attendance

If you arrive more than 15 minutes late to a scheduled session without prior notice, DynamicStep reserves the right to treat the session as a no-show. Any remaining time in the session period will be provided at DynamicStep's discretion.

8.5 No-Shows

If you do not attend a scheduled session without prior notice, the session is forfeited. No refund, credit, or rescheduling entitlement arises from a no-show.

8.6 Session Expiry

Coaching sessions, whether purchased as a single session or as part of a package, must be used within 6 months from the date of purchase unless otherwise agreed in writing. Sessions not used within this period will expire without refund.

8.7 Cancellations by DynamicStep

If DynamicStep needs to cancel a scheduled session, DynamicStep will provide as much notice as reasonably practicable and will offer to reschedule. If rescheduling is not possible within a reasonable timeframe, a proportionate refund may be provided for that session.

8.8 Communication Boundaries

DynamicStep will communicate with you through agreed channels (for example, email, video conferencing platforms, or the Payhip messaging system). DynamicStep is not able to provide support outside scheduled sessions or agreed communication channels and cannot guarantee response times for general enquiries. DynamicStep does not provide after-hours clinical support or advice.

9. Intellectual Property

9.1 Ownership

All content created and published by DynamicStep, including but not limited to the online course, coaching materials, videos, audio recordings, PDFs, written guides, exercise programs, worksheets, branding, Website content, blog posts, social media content, and downloadable resources ("DynamicStep Materials") is owned by or licensed to DynamicStep and is protected by Australian and applicable international copyright, trademark, and other intellectual property laws.

9.2 Licence to Use

Upon purchase and receipt of cleared payment, DynamicStep grants you a limited, non-exclusive, non-transferable, personal licence to access and use the DynamicStep Materials solely for your own personal, non-commercial purposes in accordance with these Terms. This licence does not transfer any ownership or intellectual property rights to you.

9.3 Prohibited Uses

You must not, without the prior written consent of DynamicStep:

  • Copy, reproduce, distribute, republish, upload, post, or transmit any DynamicStep Materials;

  • Share login credentials or account access with any other person;

  • Resell, sublicense, or otherwise commercially exploit any DynamicStep Materials;

  • Create derivative works based on DynamicStep Materials;

  • Use DynamicStep Materials for any AI training, machine learning, or data processing purpose;

  • Remove or alter any intellectual property notices from DynamicStep Materials; or

  • Record any live or video coaching session without the prior written consent of DynamicStep.

9.4 Breach of Intellectual Property

Any unauthorised use of DynamicStep Materials constitutes a breach of these Terms and may constitute an infringement of intellectual property rights, which DynamicStep reserves the right to enforce.

10. Acceptable Use

When using this Website or DynamicStep services, you agree not to:

  • Use the Website or services for any unlawful purpose or in breach of any applicable law;

  • Harass, threaten, abuse, or intimidate DynamicStep or any other person;

  • Upload, post, or transmit any malicious software, spam, or harmful code;

  • Attempt to gain unauthorised access to any part of the Website or platform, including other users' accounts;

  • Share, transfer, or sell your account access or login credentials to any other person;

  • Use DynamicStep's name, branding, or content in any manner that could cause confusion or reputational harm;

  • Submit false, misleading, or defamatory information; or

  • Engage in any conduct that disrupts or interferes with the delivery of services to other users.

11. Technology and Platform Limitations

11.1 Third-Party Platforms

DynamicStep delivers its online course and processes payments through Payhip and may use other third-party platforms for video conferencing, communication, and administration. DynamicStep does not control these platforms and is not liable for any failure, interruption, data loss, or other issue arising from their use.

11.2 Service Interruptions

Access to the Website, online course, or coaching sessions may be affected by technical failures, internet connectivity issues, platform outages, scheduled maintenance, or circumstances outside DynamicStep's control. DynamicStep does not warrant uninterrupted or error-free access to its services.

11.3 Internet Dependency

You are responsible for maintaining an adequate internet connection and compatible device to access DynamicStep services. DynamicStep is not liable for any failure or reduced experience resulting from your technical environment.

11.4 Technical Issues During Sessions

If a coaching session is materially disrupted by a technical failure attributable to DynamicStep's platform, DynamicStep will offer to reschedule the affected session. If a technical issue is attributable to your equipment or internet connection, the session will be treated as attended to the extent it proceeded.

12. Limitation of Liability

12.1 General Limitation

To the maximum extent permitted by law, DynamicStep's total aggregate liability to you for any claim arising out of or in connection with these Terms, the Website, or any DynamicStep product or service (including but not limited to breach of contract, negligence, or any other cause of action) is limited to the amount you actually paid to DynamicStep for the specific product or service giving rise to the claim.

12.2 Exclusion of Consequential Loss

To the maximum extent permitted by law, DynamicStep excludes all liability for:

  • Loss of income, revenue, or profit;

  • Loss of data or information;

  • Indirect, incidental, special, or consequential loss or damage;

  • Loss arising from reliance on general educational content;

  • Injury, harm, or adverse health outcomes arising from your participation in exercise activities;

  • Technical failures, platform outages, or loss of access to digital products; and

  • Any third-party acts or omissions in connection with the delivery of services.

12.3 Exercise and Health Risks

DynamicStep expressly excludes, to the extent permitted by law, any liability for injury, harm, or adverse health outcome arising from your participation in any exercise activity described or demonstrated in DynamicStep materials, where such injury or harm results from:

  • Your failure to obtain appropriate medical clearance;

  • Your failure to disclose a pre-existing condition;

  • Your exercise of activities beyond your physical capacity; or

  • Your failure to follow any safety guidance provided.

12.4 Commercially Reasonable Position

Nothing in this clause is intended to exclude liability that cannot be excluded by law, including liability arising under non-excludable consumer guarantees under the Australian Consumer Law.

13. Australian Consumer Law

13.1 Non-Excludable Guarantees

Under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), certain guarantees apply to the supply of services and cannot be excluded, restricted, or modified. These include guarantees that services will be provided with due care and skill, and that services will be fit for the disclosed purpose. Nothing in these Terms purports to exclude, restrict, or modify any right or remedy that cannot lawfully be excluded.

13.2 Permitted Limitations

Where DynamicStep is permitted by law to limit its liability for a failure to comply with a consumer guarantee, DynamicStep's liability is limited (at DynamicStep's election) to:

  • In the case of services: re-supplying the services; or paying the cost of having the services supplied again.

  • In the case of digital products: replacing the product, repairing the product, or refunding the purchase price.

13.3 Consumers Outside Australia

If you are accessing DynamicStep services from outside Australia, local consumer protection laws in your jurisdiction may apply and may provide rights in addition to or different from those under Australian law. DynamicStep does not limit any rights that cannot be excluded under your local law.

14. Indemnity

You agree to indemnify, defend, and hold harmless DynamicStep, its operators, contractors, and agents from and against any claim, loss, liability, cost, or expense (including reasonable legal costs) arising out of or in connection with:

  • Your breach of these Terms;

  • Your misuse of DynamicStep Materials or the Website;

  • Your participation in exercise activities in a manner inconsistent with the guidance provided;

  • Your failure to obtain medical clearance where required;

  • Any false or inaccurate information you provide to DynamicStep; or

  • Any conduct by you in connection with the use of DynamicStep services that causes loss or harm to DynamicStep or any third party.

15. Privacy and Data Handling

15.1 Who Collects Your Information DynamicStep (Scott William Rayment, ABN 28 124 155 190) is the data controller for personal information collected through this Website and its services. DynamicStep is committed to handling your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and any applicable state legislation.

15.2 What Information We Collect DynamicStep may collect the following categories of personal information:

  • Identity and contact information: name, email address, and billing address provided at checkout

  • Payment information: processed and stored by Payhip and its payment processors — DynamicStep does not store your card details

  • Health-related information: ankle injury history, symptoms, and rehabilitation context, collected only in the course of 1:1 coaching services and where voluntarily provided

  • Usage information: general data about how you access and interact with course materials, collected by Payhip and other platforms used to deliver services

  • Communications: records of emails or messages you send to DynamicStep

15.3 Why We Collect It Your personal information is collected and used only for the following purposes:

  • To process your purchase and deliver the product or service you have bought

  • To communicate with you about your order, access, or coaching sessions

  • To provide coaching support and, where relevant, record session notes

  • To respond to your enquiries or support requests

  • To comply with legal obligations, including Australian Consumer Law and taxation requirements

  • To improve DynamicStep products and services (using aggregated, non-identifiable data only)

DynamicStep will not use your personal information for any purpose beyond those listed above without your consent.

15.4 Health Information Health-related information is sensitive information under the Privacy Act 1988 (Cth) and is handled with a higher standard of care. DynamicStep collects health information only where it is directly relevant to delivering coaching services, and only with your knowledge. Health information will not be disclosed to any third party except where required by law, where you have given explicit consent, or where disclosure is necessary to prevent a serious and imminent threat to your health or safety or that of another person.

15.5 Disclosure to Third Parties DynamicStep does not sell, rent, or trade your personal information. Information may be shared with the following categories of third parties only to the extent necessary to deliver services:

  • Payhip (payhip.com): processes payments and delivers digital products. Payhip's privacy policy is available at payhip.com/privacy

  • Video conferencing platforms (such as Zoom or Google Meet): used to deliver coaching sessions. These platforms have their own privacy policies

  • Email service providers: used to send transactional and service communications

  • Legal or regulatory authorities: where disclosure is required by law or court order

15.6 Data Storage and Security DynamicStep takes reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. Digital records are stored on password-protected systems. Health-related coaching notes are stored securely and separately from general communications where practicable. No data transmission over the internet is completely secure, and DynamicStep cannot guarantee absolute security.

15.7 Retention DynamicStep retains personal information only for as long as necessary for the purpose for which it was collected, or as required by law. In general:

  • Purchase and transaction records: 7 years (taxation and consumer law obligations)

  • Coaching session records: 7 years from the date of last service for adult clients, in accordance with health records retention guidelines

  • General communications: until no longer reasonably required for the purposes of the service

When information is no longer required, it will be securely deleted or de-identified.

15.8 Your Rights You have the right to:

  • Request access to the personal information DynamicStep holds about you

  • Request correction of inaccurate, incomplete, or outdated information

  • Request that your information be deleted, subject to legal retention obligations

  • Withdraw consent to the use of your information for any purpose beyond delivery of contracted services, subject to the impact on service delivery

To exercise any of these rights, contact DynamicStep at info@dynamicstep.com.au. DynamicStep will respond within 30 days.

15.9 Complaints If you believe DynamicStep has handled your personal information in a way that breaches the Australian Privacy Principles, you may lodge a complaint by emailing info@dynamicstep.com.au. DynamicStep will acknowledge your complaint within 5 business days and respond substantively within 30 days. If you are not satisfied with DynamicStep's response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

15.10 Cookies and Website Analytics This Website may use cookies or similar tracking technologies to improve user experience and collect general usage data. No personally identifiable information is collected via cookies without your knowledge. You may disable cookies through your browser settings, though this may affect some Website functionality.

18.1 Termination by DynamicStep

  • You have engaged in conduct that DynamicStep reasonably considers abusive, harassing, or inappropriate;

  • You have failed to make any payment due under these Terms;

  • You have misused DynamicStep Materials, including sharing account access or using materials in breach of clause 9; or

  • DynamicStep ceases to offer the relevant service.

18.2 Effect of Termination

Upon termination for breach or misuse, no refund will be provided. DynamicStep reserves the right to pursue any legal remedies available for breach of these Terms.

18.3 Termination by You

You may cancel a coaching agreement at any time in writing, subject to the refund terms set out in Section 7. Termination does not relieve you of any outstanding payment obligations.

19. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal courts of Australia for the resolution of any dispute arising under or in connection with these Terms. DynamicStep and the User will first attempt to resolve any dispute by good faith negotiation before commencing formal proceedings.

20. General Provisions

20.1 Entire Agreement

These Terms, together with any service-specific agreement or confirmation provided at the time of purchase, constitute the entire agreement between you and DynamicStep in relation to the subject matter and supersede all prior representations, discussions, and agreements.

20.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed to the extent of its invalidity and the remaining provisions will continue in full force.

20.3 No Waiver

DynamicStep's failure to exercise or enforce any right under these Terms does not constitute a waiver of that right.

20.4 Assignment
